Client Booking and Event General Terms and Conditions

The following terms and conditions for hiring of artistes and booking of tailor made theme shows must be adhered to but can be altered by agreement with COSAM in writing where the situation arises that different terms suit both parties.

  1. For both Domestic and International business the Courts of England and Wales will have jurisdiction over terms and conditions.
  2. For hiring of artistes that we actively promote an immediate 20% deposit is required unless the artiste has their own % deposit which will take precedent and this will be made clear at the outset when the enquiry is made.
  3. The deposits are non-refundable if the booking is cancelled by the client.
  4. If the booking is simply deferred to another agreeable date then the deposit paid can be used for the re-arranged date.
  5. Balances of fees for hiring of artists after the deposit has been paid must be paid prior to three weeks of the event unless special terms are agreed to by COSAM, client and artiste and in writing.
  6. If the balance has not been paid by the client within the three weeks prior to the event we reserve the right to withdraw the artist from performing or if the booking is cancelled by the client within three weeks prior to the event the full balance is still payable.
  7. If it has been agreed for the client to pay the balance to the artiste/act on the day/night of their performance the agreed fees must be paid.
  8. If the client does not pay the artist the balance of agreed fees on the day/night of the performance after it has been agreed then we reserve the right to pursue recovery of the fees from the client in accordance with the current law at the time of the booking.
  9. For arrangement of shows where there is a profit or takings split between COSAM, ARTISTE and CLIENT special terms and conditions will be agreed beforehand and in writing.
  10. We shall try to accommodate variances to the above terms and conditions where ever possible but agreement must be made prior to confirmation of booking of act/artiste.
  11. When an act/artiste is booked sufficient electricity points must be made available and provided for the entertainer to use.
  12. Relevant health and safety policies must be in place at commercial premises and the artiste/act or COSAM will be entitled to take action under the relevant law at the time of the performance if the client is suspected of being negligent following any incidents.
  13. For domestic/private gigs the health and safety of the act/artiste is paramount at all times and the artiste/act or COSAM will be entitled to take action with the relevant law at the time of the performance if the client is suspected of being negligent of any incidents.
  14. The above terms and conditions are binding unless specifically altered by agreement with COSAM, act/artiste and client.
Force Majuere

A party (us or the performer) is not liable for failure to perform the party’s (the client) obligations if such failure is a result of:

Acts of God (including fire, flood, earthquake, storm, hurricane or other natural disaster), War, invasion, act of foreign enemies, hostilities (regardless of whether war is declared), Civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalisation, government sanction, blockage, embargo, labour dispute, strike, lockout or interruption or failure of electrical supply or telephone service.

We cannot be held responsible nor be liable for failure to perform obligations due to unforeseeable events or happenings beyond our control that prevent the performance.

If a performer is ill and cannot perform we cannot be held liable for such uncontrollable events. We will, however, strive to secure alternative performers to fulfil our obligations to parties.

If a performer fails to fulfil their obligations to parties we cannot be held responsible for their actions.

If COSAM is at fault in not fulfilling our obligations we will give full refunds on monies paid including deposits and final balances.

COSAM cannot be held responsible for a performer’s poor quality of performance. (Sometimes they do have ‘off’ days where it could be due to an impending illness or other uncontrollable reason).
However, we do endeavour to provide entertainment and entertainers of great quality and it is our policy to make sure we provide the best of entertainment and entertainers and our ultimate goal is to give excellent value for money.
